BackWeb Technologies Ltd. (Pink Sheets: BWEBF or BWEBF.PK) announced today that it filed a lawsuit in the United States District Court in San Francisco, California against Microsoft Corporation, alleging patent infringement and seeking damages, an injunction and a declaration by the Court that Microsoft's software update technologies infringe BackWeb's patents.
BackWeb alleges Microsoft's Background Intelligent Transfer Service (BITS), Windows Update and other products infringe four U.S. patents owned by BackWeb covering methods for transmitting information between a remote network and a local computer and distributed client-based data caching systems. The Microsoft products at issue are used for, among other things, regularly updating the Microsoft Windows operating system, Internet Explorer browser, and Office applications. Additionally, the BITS product is used by other companies developing applications on the Windows operating system.
BackWeb was a pioneer in Internet "push" communications technology, and since 1995 it has developed technology and products related to efficient Internet-based communication and notification which were sold to hundreds of customers and used by tens of millions of users. BackWeb research and development teams have developed multiple patented technologies in the field of efficient and user friendly data communications. BackWeb is being represented in this matter by San Francisco law firm Hosie Rice LLP. A copy of the complaint is available on our web site at http://www.backweb.com/news_events/.
