Microsoft “circumventing and undermining” European law

SOFTWARE GIANT Microsoft was giving a ticking off by a Boston judge for trying to circumvent and undermine European law.

As part of its legal battle against EU sanctions for its anti-trust behaviour, the Vole had asked a US court to force is rival Novell to hand over documents it had presented to the European Commission in its anti-trust complaint against Microsoft.

Boston district court judge Mark Wolf said that enforcing Microsoft’s subpoena to Novell would circumvent and undermine the law of the European Community concerning how a litigant may obtain third-party documents.

So far Microsoft has demanded that Oracle, Sun and IBM hand over documents. A Californian judge told Vole it couldn’t have Sun and Oracle documents and a New York robed, but not wigged one, is contemplating the matter.
